REDWOOD CITY, Calif. – The Obama administration has ordered public schools to let transgender students use bathrooms and locker rooms that match their current gender identity.
Failure to comply risks losing federal funding.
The order was issued amid a nationwide debate over which bathrooms transgender K-12 students should be allowed to use.
The joint letter comes from the US Department of Education and the Justice Department.
The directive is not law, though federal officials believe bathroom rights fall under federal anti-sex discrimination law in education.
The message behind the letter is clear the government wants schools to either follow its guidance, or face loss of federal funding.
Critics, like Texas Lt. Governor Dan Patrick slammed Obama’s order, calling it blackmail.
“He says he’s going to withhold funding if schools do not follow the policy,” Patrick said Friday. “Well in Texas, he can keep his 30 pieces of silver. We will not yield to blackmail from the President of the United States.”
