The real issue is much much larger than illegal immigration. What the SCOTUS needs to decide are the limitations on executive authority. Read the Constitution. I cannot find one word that gives executive authority to any president (except veto power) without congressional approval no matter how often or how long those executive actions have been taken in the past. Does any president have the executive authority to create new laws, change existing laws, or ignore law without Congress’ approval? If the answer is “yes” as Obama has decided, then there is no longer any need for a legislature and we have evolved to a dictatorship. If the answer is “no” as I believe it is under our Constitution, then most if not all of Obama’s “executive actions” are meaningless and illegal. That is the question that the SCOTUS must decide at some point, and it needs decided right now. A broad ruling defining the Separation of Powers is needed, not some narrow ruling on just amnesty that continues the abuse of power.
