Obama remains confident despite setback in immigration relief

REDWOOD CITY, Calif. – President Barack Obama vowed to keep fighting for his executive orders on immigration, which have just been blocked by a federal judge. “I disagree with the Texas judge’s ruling and the Justice Department will appeal,” he said.

But Obama may be in for a challenge. His administration’s appeal to the ruling will head to what it considered the most conservative federal appeals court in the country, the Fifth Circuit. Its active judges are Republican by a 2 to 1 margin.

It may take months for the courts to decide on his executive orders, but Obama remains confident.

He pointed out, “This is not the first time where a lower court judge has blocked something, or attempted to block something, that was ultimately shown to be lawful. And I’m confident that it is well within my authority and the tradition of the executive branch’s prosecutorial discretion to execute this policy that will help to make our borders safer. It will help us go after criminals and those we don’t want in this country. It will help people get on the right side of the law and get out of the shadows.”

Under Obama’s executive orders, eligible undocumented youth would have been able to apply for deportation relief and work permits beginning February 18. Undocumented parents of U.S. citizens or permanent residents would have also been able to apply for the same relief measures in May.

About five million undocumented immigrants stand to benefit from these orders.

But for now, Homeland Security Secretary Jeh Johnson has vowed to comply with the court and said he will not implement the orders until the legal issues are resolved.

Filipino-American Attorney General Sean Reyes of Utah, one of the states that sued, pointed out, “We did not join this lawsuit to address immigration policy. Whether you agree or disagree with some, all or none of the president’s proposals is not the point. The process of how President Obama overstepped his legal authority is what is being challenged.”

The president’s executive orders are of course a temporary fix. And following this setback, Obama told lawmakers that if they’re really concerned about immigration, about our borders and keeping criminals out of this country – then they need to pass a lasting and comprehensive bill.

    obobo is full of bullcrap to defend his illegal alien amnesty executive order will make the borders safer, and will deport criminals. obobo should be tried in the court of law to answer why his administration have freed from jail illegal alien criminals, now living among the citizens, instead of deporting them back to where they all came from. why obobo got away with his in your face directing ICE not to arrest / deport illegal aliens. the job of obobo is to deport illegal aliens, not to pay them off with amnesty. this a$$hole POTUS simply have done too much damage to the integrity of america’s sovereignty with his illegal alien executive order, such as the flood of minor illegal alien border crossers. the border chaos were taken advantage by muslim terrorists to blend among the crowd to enter the USA, now living among the citizens. so WTF this contemptible obobo is saying his executive order will help go after criminals, when he has not done his job to deport them in the first place. all these freaking liberal deceptions of passing immigration comprehensive bill will solve the perennial problem of illegal alien are the treachery of obobo / the demonicraps. the so called immigration comprehensive bill is to rewrite / twist the immigration laws to legalize all of illegal aliens illegal actions as a free ride to lawful status. there is nothing wrong with the existing immigration laws, its the federal, the POTUS is the problem of not doing his job to deport illegal aliens, who are now into self empowerment, radically directing the socialist, far out lefty government to fanatically alter the immigration laws to favor their decades of bootlegging in america.

    Heres a simple way to explain the whole scenario , so that Filipinos would know they been lied too by OBAMA.

    Obama didn’t create or sign an EXECUTIVE.ORDER. He had Jeh Johnson, head of DHS, write a memorandum. That was it!! Obama didn’t bother to sign the memo. The White House lied and said there was an executive order when there was NONE.

    The Judge says in his opinion that Jeh Johnsons memo is the focus of the TRO because there is NO E.O. Executive orders must be filed and none are found regarding the DACA that Obama issued.

    This falls in line with Obama’s MO. He never gets his hands dirty. He makes his employees do the dirty work. Obama said over 22 times that he doesn’t have the authority to change immigration rules.

    Here is part of Judge Hanen’s opinion:

    Hanen’s opinion opens with: “This is a case in which twenty-six states or their representatives are seeking injunctive relief against the United States and several officials of the Department of Homeland Security to prevent them from implementing a program entitled ‘Deferred Action for Parents of Americans and Lawful Permanent Residents.”

    “Noting that the case does not pertain either to a law passed by Congress or to an executive order signed by Obama, Hanen noted the White House promoted the idea that the president had signed an executive order in Las Vegas Nov. 21, 2014, the day after his address to the nation on immigration.”

    The president was seen signing two presidential executive orders, but they were not related to deferring prosecution of illegal aliens.

    Hanen wrote that “both sides agree that the president in his official capacity has not directly instituted any program at issue in this case.”

    “Regardless of the fact that the Executive Branch has made public statements to the contrary, there are NO executive orders or other presidential proclamations or communiqué that exist regarding DAPA [Deferred Action for Parents of Americans and Lawful Permanent Residents],” he said.

    “The DAPA memorandum issued by Secretary Johnson is the focus in this suit,” the judge stated.

    In granting the injunction to the 26 states that brought the lawsuit, led by Texas, Hanen made clear that the DHS memorandum signed by Johnson was unconstitutional.

    DHS does not have the authority to defer the deportation of more than 4 million foreigners who entered the U.S. illegally or overstayed their visas, the judge said.

    “The DHS was not given any ‘discretion by law’ to give 4.3 million removable aliens what the DHS itself labels as ‘legal presence,’” Hanen concluded.

    “In fact, the law mandates that these illegally present individuals be removed. The DHS has adopted a new rule that substantially changes both the status and employability of millions. These changes go beyond mere enforcement or even non-enforcement of this nation’s immigration scheme.”

    If Jarrett/Obama had signed Jeh Johnsons memorandum it would have been a different situation and be an E.O. if Obama had signed it. Obama didn’t sign the memorandum.

    That is why Jeh Johnsons memorandum is the focus of this case.
    Jeh Johnson must be in panic mode right now. He would take the fall for fraud not Obama.

    All Executive.Order.’s must be filed. There is none on file.
    Please correct people when they say Obama’s Executive.Order. THERES IS NONE.

    Jarrett/Obama and the White House lied and the MSM and the W.H. continue with the lie.

      Enigma ,Thanks for clarifying and making it more simple to understand this very complicated issue.

      Obama doesn’t know sh*t. the people running Obama knew this Executive Order would not fly. When we put the burden of Crime on his shoulders, yes, his may be the pen which makes the hen scratchings on paper, but Obama doesn’t know anything. Let me repeat, Obama knows nothing .

      Note to Obama who is confusing activists justice with the law:
      ‘Just because the Department of Justice and justice Al Sharpton is on your side doesn’t mean the law is’.

      Enigma, your findings alone should throw obobo out of the WH, straight to prison, even without impeachment process, together with his appointees corrupt accomplice on scams of the executive branch. how in the world the DACA scam got into action with the issuance of documents allowing these illegal aliens temporary legal status to be employed, procured driver licenses, costing millions of dollars spent on these illegal aliens, which should have been spent in deporting them to lessen the burden to the nation / to the hardworking taxpayers. obobo’s administration should be dismantled for the sake of the citizens, many freely drunk the poison obobo handed to them, to become obobo’s die hard lovers / supporters. this is indeed a huge scandal, that seem not to get tractions to anger the general public, with obobo, the con man is the same kind as the outlawed illegal aliens, kept on talking bullcrap he will prevail on his fight for illegal aliens. all these wicked bunch running the government will run out of time, to one day all of these dishonest, wicked obobo’s appointees, headed by odious obobo will all live in jail for a very, very, very, very long time.

      It’s an unconstitutional illegal alien amnesty executive order fight. This is NOT about LEGAL immigration. It never has been. It is about illegal aliens who break our laws by crossing the border illegally, jumping ahead of those who try to emigrate LEGALLY, and then demanding U.S. taxpayer-funded handouts and work permits, which Obama has illegally and unilaterally granted them.

      That’s why U.S. District Court Judge Andrew Hanen smacked him down. Of course Obama doesn’t get it. Illegal entry into the country is equivalent to a felony punishable by two years’ imprisonment. Document fraud is subject to fine and imprisonment; so is alien marriage fraud. Evading deportation is a serious crime; illegal re-entry after deportation is punishable by ten years’ imprisonment.

      Foreigners may be kicked out of the country without due process and the endless bites at the litigation apply that illegal aliens are afforded in America.

        There is no E.O. using DACA. It was just a memo from Jeh Johnson. Obama didn’t sign it or register it with the Federal Register.

        Obama will continue with the lie for as long as it takes. He doesn’t care about a TRO (temporary restraining order/injunction) from Judge Hanen or any judge.

        He is doing his best to stir up the illegal aliens. They are already threatening militant action in our streets if they don’t get what they consider their rights. Illegal aliens have no rights. That’s why they are called illegals. They have already broken our laws by coming across our borders.

        In the meantime he and Holder are court shopping hoping to find some judge who will nullify Judge Hanen’s opinion. Obviously they haven’t found one yet but they will eventually find a liberal judge willing to nullify without Obama and Holder having to produce an E.O. that doesn’t exist.

        Obama is a community agitator and a law breaker. Obama wants chaotic protests in the streets. He lives for it. He wants to divide this nation and he’s doing a bang up job.



        I’ll bet it’s televised on all major networks and the people attending will be handpicked and most will be illegals. The Obama W.H. want loud applause so they can say see how popular Obama is ?
