MANILA – The Makati Regional Trial Court has ordered the transfer of alleged pork barrel scam queen Janet Napoles’ to the Correctional Institute for Women in Mandaluyong after finding her guilty of illegally detaining whistleblower Benhur Luy.

The commitment order was issued this afternoon by the court’s Branch 150.

In a separate interview with dzMM, Napoles’ lawyer and spokesman Bruce Rivera said the Napoles camp has not received the commitment order but the “place of detention” is a “dilemma.”

He said the Sandiganbayan, which is still hearing Napoles’ separate cases for graft and plunder, earlier ordered the businesswoman’s transfer to Camp Bagong Diwa in Taguig from Fort Sto. Domingo in Sta. Rosa, Laguna.

“But she’s already jailed [anyway]. We just don’t know the administrative considerations there… Some people say she was convicted by the trial court so it will be the one to decide where she will be jailed. [On the other hand], the Sandiganbayan is a higher court,” Rivera said.

Nonetheless, Rivera said: “A jail is a jail. We don’t have a first preference.”

Napoles was in court this morning when Judge Elmo Alameda read the decision.

Napoles was sentenced to reclusion perpetua or 20 years and one day to 40 years in prison.

Rivera said they informed the court that they will be filing an appeal. He said they have yet to discuss whether to file a motion for reconsideration or move to directly appeal before a higher court.

Asked how Napoles is doing, Rivera said he won’t stress on how the businesswoman is currently faring lest the public say they are using health issues to get sympathy.

“It’s a stressful life [inside the jail]… We would not say she’s OK,” he said.
