Filipinos say U.S. court rulings could speed up reunification of families

GLENDALE, Calif. – While comprehensive immigration reform has been slowed down in Congress, Filipinos here believe they’re reaping the benefits of recent court rulings that give their aged-out children a chance to join them in the U.S.
Journalist Sid Balatan said he welcomes any court decisions that would allow aged-out children to receive visas under their parents’ petitions.

He believes such rulings may help bring his two children, ages 26 and 27 to the U.S. sooner than he originally thought.

He pointed out, “Every family wants to be complete.”

When he moved to the U.S. from the Philippines in 2011, through his mother in law’s petition, he had to leave two of his children behind because they were both over 21 years old by the time the petitions were approved.

He believes a previous ruling in California may be working in his favor. In 2012, a court decision allowed expired petitions processed before a child aged-out at 21 to be refiled.

The U.S. Supreme Court is also currently considering allowing children who turned 21 while waiting for petitions to be approved, to continue.

This would possibly pave the way for these aged-out children to join their families in the U.S. and for those already here on expired petitions to remain in the U.S. legally.

When it comes to family-based petitions, the Philippines has one of the longest petition wait times, averaging over 20 years.
Rudy Feran is also hoping this ruling can bring his grandchildren to the U.S., even though his children have since aged-out and started their own families since his original petitions two decades ago.

“I want them to have the chance to have a future in America,” he said.

Ideally, many Filipinos here said they would like to see a comprehensive bill that addresses family petition backlogs.

But for now, these court rulings have become their best hope for an expedited reunification with some of the loved-ones they left behind.

    visa applicants already in front of the line will be affected with much delays, by affording visas to way out lawful adults family based petitions.

    CSPA loopholes are openings to butt in non-american cultures arguments before the SCOTUS all for the emotions of family unity. american family cultures/traditions, once a child turns 18 years old is considered an adult, at legal age to vote, get married without parental consent, find a job to pay rent, in order to move out of their parents home, as expected by the parents. Many are working students to self-pay college tuitions. this american cultures/traditions for a fact are cringe upon by aliens, whose culture is the family nucleus, many with extended families included are all in one space. BTW may not mean in unity. it can create much irritations for too close to be on top of each other space/face.

    the iNS was generous enough to use the age of 21 as the break point to be eligible beneficiary of family based visa petition, instead of 18 years old. the congress enactment of CSP is facing the cause and effect of the ruling, using the family unity sentiments to sway the justices to favor the age-out, instead of looking truthfully, and realistically, that the way out adults, and their families are all for economic reasons. this is the baddest economy america is facing without light at the end of the tunnel for solutions, currently categorized the USA’s economy at the 12th place globally. americans concern is the economy. the recent poll only 2% americans for immigration.
