REDWOOD CITY, Calif. – In San Diego, the Filipino-American man accused of killing three people on Christmas Eve last year has been declared incompetent for trial, according to a report issued Monday by a court psychiatrist.
Now prosecutors may ask for a separate trial, to determine if Carlo Mercado is competent enough to understand the charges filed against him.
Mercado is accused of shooting two people in a shopping center parking lot. A third was found dead in Mercado’s car a hundred miles away three weeks later.
Mercado, who was arrested last June after DNA evidence linked him to the crime, is scheduled for another hearing next week.
If he goes to trial, he faces the death penalty.
