Advocates seek temporary protected status for undocumented Filipinos following typhoon

REDWOOD CITY, Calif. – In the aftermath of Typhoon Yolanda, Migrant Heritage Commission, a Washington DC based advocacy group, is calling on the U.S. government to grant Temporary Protective Status (TPS) to Philippine nationals living, working and studying in America.

The Secretary of the Department of Homeland Security (DHS) may designate a country or portions of a country for TPS if it suffered from a devastating calamity, or if the Attorney General finds that the situation in the foreign country prevents its nationals from returning to it because of safety issues.

While not required, it is typical for the Philippine government to first request TPS before the Secretary of the DHS makes a designation. Once a country receives a TPS designation, its nationals in the U.S. may receive a temporary, humanitarians form of relief from deportation that does not include the granting of permanent residence. The initial TPS designation is expected to last between six to 18 months and can be extended depending on the circumstance in their homeland.

This would allow Filipino nationals who are in the U.S. to continue living, working and studying in America, regardless of when their visas expired.

U.S. officials such as Senators Chuck Schumer, Ben Cardin and Robert Menendez have supported this initiative, as well as the members of the American Immigration Lawyers Association (AILA).

But there are limitations. Attorney Maricar Madrid-Crost of AILA said, “To be eligible, they should not be convicted of any felony or two or more misdemeanors committed in the U.S.”

Attorney Arnedo Valera of the Migrant Heritage Commission said undocumented immigrants should also get TPS, and should also get work and travel permits. Not only will this “strengthen foreign relations between the U.S. and the Philippines”, Valera said, “It will allow Filipino nationals in the U.S. to keep the Philippine economy afloat by continuing to send dollar remittances. This can help the Philippines in the recovery efforts after Typhoon Yolanda.”

The Migrant Heritage Commission has already sent a letter to President Barack Obama to designate the Philippines as a TPS country. Congress dot not vote on it. It is up to the President and his agencies to make the final determination.

Currently, TPS-designated countries include El Salvador, Haiti, Honduras, Nicaragua, Somalia, Sudan, South Sudan and Syria.

    Mga ibang filipino talaga gusto sila lang ang aangat sa buhay. Wala pa nga yung TPS mga kontra agad at isa pa 18 months lang yan kung maibigay man ng DHS yang mga undocumented na filipino nagtartrabaho ng marangal karamihan caregiver kaya sigurado ako mahal na mahal sila ng mga amerikano at nakpunta sila dito na nag apply s US Embassy hindi sila tumalon tulad ng ibang nationality at isa pa ang ibang nationality sinusuportahan nila kababayan nila para maging legal tulad ng mga mexicano e kayong mangilanngilan na filipino nakakahiya kayo gusto nyo malugmok ang mga kababayan nyo na undocumented gusto nyo hanggang dun nalang sila kung may trabaho lang s pilipinas sigurado ako di sila magpapakahirap na mag caregiver para lang may mapadalang pera sa mga anak nila sa pilipinas at yung hirap at lungkot na nararanasan nila dito dahil karamihan sa kanila wala namang pamilya na matatawag mo na hindi katulad sa pilipinas. Kaya kayong mga makasarili na filipino, alam ko ilan lang naman kayo, mag isip kayong mabuti sa mga comment nyo kung may choice lang sila umuwi na sila malamang e kaso nga corrupt mga taga gobyerno sa pilipinas at mga crab mentality na katulad nyo. Kawawang mga kababayan ko. Sana pagpalain kayo ng diyos sa mga kabutihang gingawa nyo sa pamilya nyo s pilipinas
